Defendants Shifting International Hospital and Dr. Hamza Yousef have failed to comply with the applicable duty and responsibilities set forth in Part 4 of the Code of Criminal Procedure of Pakistan, which provides for mandatory compensation for injury or death resulting from violation of the provisions of Section 10(3) and Section 10(10) of the Act, 1860 (Act). In this case there has been serious and prolonged loss to the plaintiffs arising due to the negligence of Shifting International Hospital and Dr. Hamza Yousef. In my opinion, the plaintiffs have properly pleaded the elements of negligence. Defendant Shifting International Hospital has failed to establish the absence of negligence on its part. Defendant Dr. Hamza Yousef has failed to establish that the defendants acted in a way that does not endanger the life and health of the children as a result of a failure to provide them with proper medical care. Defendants Shifting International Hospital and Dr. Hamza Yousef have also failed to establish that the services, facilities, food and amenities provided to the plaintiffs by the defendants were of proper standard. The claims asserted in the present complaint are also not frivolous. The plaintiffs' claim against defendants Shifting International Hospital and Dr. Hamza Yousef is not that they were negligent. Instead, they claim that Shifting International Hospital and Dr.
